These Terms & Conditions (“Terms”) govern your use of the website located at https://niyn.org/ and any related services provided by the NeuroInclusion Youth Network (“NIYN”, “we”, “us”, or “our”). By accessing or using the website, registering for programs, donating, volunteering, or otherwise interacting with NIYN via the website, you agree to these Terms. If you do not agree, please do not use the website.

1. Definitions

https://niyn.org/ and all associated subpages and functionality. - User / You — any person visiting, browsing, registering, donating, applying, uploading content, or otherwise using the Website.
- Member — a User who has registered an account on the Website.
- Participant — a youth (or their guardian) who takes part in NIYN programs, events, workshops, or services.
- Volunteer — a User who offers time or services to NIYN.
- Donor — a User who makes financial contributions to NIYN via the Website.
- Content — any text, photos, videos, audio, comments, testimonials, forms, or other material uploaded to the Website.
2. About NIYN; Scope
NIYN is dedicated to supporting neurodivergent youth through advocacy, education, programs, and community building. These Terms apply to all use of the Website and related online services, including but not limited to program registrations, donations, volunteer applications, and communication tools provided through the Website.
3. Eligibility; Minors
- The Website and NIYN programs primarily serve neurodivergent youth ages 13–25. Participation by minors under 18 requires verifiable parental or legal guardian consent as described in our registration processes.
- By registering or enrolling a minor, you represent that you are the minor’s parent/legal guardian and consent to participation and any media release or waivers required.
- If your jurisdiction sets a higher minimum age for online accounts, you must be old enough under that law to use the Website.
4. Accounts; Registration
- To access some features (event registration, forums, volunteering portals, donation history), you may need to create an account and provide accurate, up-to-date information.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- We may suspend or terminate accounts that violate these Terms, misrepresent identity, or present risk to participants or NIYN.
5. Program Participation, Events & Waivers
- Participation in programs, workshops, or events may require separate registrations, forms, medical disclosures, background checks (for volunteers working with youth), and signed waivers/liability releases.
- Some activities may carry physical or emotional risk. Participants and guardians must follow NIYN staff instructions and safety guidelines. NIYN may refuse participation where it reasonably believes a User’s health or behavior poses a risk.
- By registering for in-person activities, participants (or guardians) consent to any emergency medical assistance that NIYN reasonably deems necessary and agree to be responsible for related costs.
6. Donations & Payments
- Donations may be made online via third-party payment processors. By donating you agree to the processor’s terms and NIYN’s donation policy.
- Refunds: Donations are generally non-refundable except where required by law or at NIYN’s sole discretion (e.g., duplicate charges or processing errors). If an event fee is charged and the event is canceled, NIYN’s event cancellation policy will apply.
- Tax receipts: Tax deductibility of donations depends on local law and NIYN’s charitable status in relevant jurisdictions. NIYN will provide receipts where appropriate. Donors should consult a tax advisor.
7. Volunteers & Background Checks
- Volunteers who work directly with youth may be required to submit references and undergo background checks as part of NIYN’s safeguarding policy.
- Volunteers must follow NIYN’s code of conduct and safeguarding procedures. Violations may result in removal from volunteer roles or referral to authorities if necessary.
8. User-Generated Content & Conduct
- By submitting Content (testimonials, forum posts, photos, videos), you grant NIYN a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, publish, distribute and display such Content in connection with NIYN’s mission, including marketing, on the Website and social channels.
- You represent and warrant that you own the rights to submitted Content or have obtained necessary consents (including from parents/guardians for minors in media).
- Prohibited content includes hate speech, harassment, sexually explicit material, personal medical diagnoses of others, personal identifying information of minors without consent, or other unlawful content. NIYN reserves the right to remove, edit, or refuse any Content.
- For copyright complaints (DMCA-style takedown requests), email a detailed notice identifying the copyrighted work, the URL of the infringing material, and your contact details.
9. Photo & Media Release
- With consent, NIYN may photograph/video participants during programs and events. Unless you opt out during registration, you grant NIYN permission to use such media for promotional and programmatic purposes.
- Guardians may opt out of media use for minors by following opt-out procedures on the registration form or contacting NIYN prior to the event.
10. Intellectual Property
- The Website and its content (design, text, graphics, logos, icons) are protected by copyright and other rights and are the property of NIYN or its licensors.
- You may view and print content for personal, non-commercial use only. Any other use (copying, redistribution, creation of derivative works) requires written permission from NIYN.
11. Privacy & Data Processing
- NIYN collects and processes personal data in accordance with its Privacy Policy. Please review the Privacy Policy for details on what we collect, how we use it, retention periods, your rights, and how to contact us about data matters.
- For parents/guardians registering minors, you confirm you have authority to provide personal data and consents on their behalf.
12. Third-Party Links & Services
- The Website may include links to third-party websites (partners, social media, payment processors). NIYN does not control and is not responsible for third-party content or practices. Use of those services is at your own risk.

- The Website content (including program descriptions, articles, and resources) is provided for general informational purposes only and does not constitute medical, psychological, legal, or other professional advice.

15. Limitation of Liability
- To the fullest extent permitted by law, NIYN, its directors, staff, volunteers, partners, and suppliers will not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of the Website or participation in programs.
- Where liability cannot be excluded under applicable law, NIYN’s total liability for direct damages is limited to the amount actually paid by you for the specific service or donation giving rise to the claim (or, if none, a nominal amount).
16. Indemnification
You agree to indemnify, defend, and hold harmless NIYN and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, and expenses (including legal fees) arising from: (a) your breach of these Terms; (b) your Content; or (c) your violation of any law or third-party rights.
17. Termination & Suspension
- NIYN may suspend or terminate access to the Website or specific services at any time, for any reason, including suspected abuse, safety risk, or legal compliance.
- Termination does not relieve you of obligations incurred prior to termination (e.g., indemnity).

NIYN may modify these Terms at any time. Changes are effective when posted on the Website with an updated Effective Date. Your continued use after posting constitutes acceptance of the updated Terms.
19. Governing Law & Dispute Resolution
- These Terms are governed by the laws of Kenya.
- Any dispute arising out of or relating to these Terms or your use of the Website shall first be referred to good faith mediation. If mediation fails, disputes will be resolved by the courts of Kenya (unless otherwise agreed in writing).
- Nothing in this section prevents a party from seeking urgent injunctive relief where appropriate.

- If you observe conduct that endangers youth, privacy breaches, harassment, or suspicious activity, contact NIYN immediately. NIYN takes safeguarding concerns seriously and will respond according to its policies.
21. DMCA / Copyright Notices
- If you believe content on the Website infringes your copyright, send a takedown notice to NIYN including:
- Identification of the copyrighted work;
- Identification of the material you claim infringes and its location (URL);
- Your contact information and a statement under penalty of perjury that you are authorized to act.
22. Miscellaneous
- Severability: If any provision is unenforceable, remaining provisions remain in full force.
- Waiver: Failure to enforce a right is not a waiver of that right.
- Entire Agreement: These Terms (and the Privacy Policy and any program-specific terms) constitute the entire agreement between you and NIYN regarding the Website.
